Poder Latinx Calls on Biden Administration to End Remain in Mexico After SCOTUS Gives Green Light
WASHINGTON, D.C. - In a 5-4 decision, the United States Supreme Court ruled against the state of Texas in the long-awaited decision on Biden v. Texas. As brought into question during oral arguments, the Supreme Court affirmed that President Biden was under no obligation to keep the Trump-era “Remain in Mexico” policy in effect when taking office. Now the case will be sent back to the lower courts in order to verify the legality of the most recent attempt to end the program.

“As the final opinion from the Supreme Court, immigrant justice organizations have finally secured a small victory in what has been a sea of conservative decision-making this term. One of President Biden’s major campaign promises was to end Remain in Mexico, and after he followed through with this promise, red states like Texas filed lawsuits against the Administration to prevent the President from using his authority to end xenophobic and racist policies that were illegal and undermined our asylum system.
This decision has come days after the tragedy that occurred in San Antonio, Texas, which has sent shockwaves of heartbreak and anger throughout the Latinx community. We are mourning the lives lost and hoping for a safe recovery for those being treated in a hospital after being trapped in deathly conditions. This tragedy was a direct result of inhumane border policies and the unjust treatment of migrants and asylum seekers in the United States. Politicians need to reflect on the implications of xenophobic programs and policies like Remain in Mexico and Title 42 will continue to have on our communities. Now, it is time for the Biden Administration to officially put an end to Remain in Mexico, dismantle other anti-immigrant policies, and restore access to seek asylum at the border,” said Yadira Sanchez, Executive Director of Poder Latinx.
