Poder Latinx: SCOTUS Decision Opens Dangerous Path Toward Undermining Birthright Citizenship

Washington, D.C. — Today’s ruling by the U.S. Supreme Court represents a grave attack on the constitutional right to birthright citizenship, setting a dangerous precedent by limiting the use of nationwide injunctions and effectively allowing the Trump administration to partially enforce an executive order that threatens the protections of the 14th Amendment. This move creates legal uncertainty, emboldens anti-immigrant agendas, and undermines the democratic principles meant to protect all people born on U.S. soil. Once again, immigrant communities are being singled out and treated as second-class citizens.

Yadira Sánchez, Executive Director of Poder Latinx, issued the following statement:

“The Supreme Court’s decision to restrict nationwide injunctions, thereby allowing part of the Trump administration’s harmful attack on birthright citizenship to proceed, is deeply alarming and leaves the future of this constitutional right in jeopardy. By enabling a discriminatory and dangerous policy to move forward, the Court is threatening the rights of children born in this country to immigrant parents, rights that are foundational to our democracy.

Let’s be clear: this is not a mere legal technicality, it is a calculated move to erode one of the most fundamental promises of equal protection under the law. Latino and immigrant communities will not stay silent. We will fight back at every level: through the courts, through community organizing, and most powerfully, at the ballot box. This year’s local and state elections, and the 2026 midterms, will be defining moments and will have consequences. We will show up with strength, unity, and purpose to defend democracy and protect our families. Our civic participation will shape the future of our communities and this nation.”
